The RNPI, of which Promundo is part, today sent a letter to President Dilma Rousseff asking her to fully sanction the Legal Framework for Early Childhood, a bill approved by Congress and which brings a series of innovations to public policies aimed at children up to six years. The Legal Framework for Early Childhood (PLC 14/2015) was processed throughout 2014 in the Chamber of Deputies, was unanimously approved in the Federal Senate during the first session of 2016, and is now under analysis by the Federal Government. The National First Infancy Network is proud to have participated in the construction of this project, in countless meetings, seminars and meetings involving numerous member organizations across the country. The Early Childhood Legal Framework determines the formulation and implementation of public policies for early childhood, considering the specificity and relevance of the first years of life in human development. In the ECA:– Inserts a paragraph that states the co-responsibility of fathers and mothers in the care and education of their children.– Provides that the Union supports the implementation of foster family care services as a public policy and provides special attention to the work of reference educators in institutional care services for children up to three years of age.– Guarantees the right of at least one of the parents to remain full-time as companions in neonatal ICUs.– Ensures that pregnant women in situations of deprivation of liberty have environments suitable to the health and care standards of the SUS for welcoming the child, and guarantees responsible hospital discharge, counter-referral in Primary Care, and access to breastfeeding support services and groups, the same rights as other pregnant women. – Includes the pregnant woman's right to receive guidance on breastfeeding, nutrition healthy complement, child growth and development.
In the CLT: – Provides that the employee stops attending work, without prejudice to salary, for up to two days to attend medical appointments and other exams during the period of pregnancy of his wife or partner, and one day per year, to monitor the child up to six years of age in medical consultation. In the Code of Criminal Procedure: – Provides for the possibility of the judge replacing preventive detention with house arrest in the case of pregnant women, women with children up to 12 years of age, men responsible for the care of children up to 12 years incomplete. – Provides that the police authorities collect information about the existence of children of the accused, and that the information appears in the arrest report in the act.
Law 11,770, “Citizen Company” law: – Establishes 20 days of paternity leave for employees of companies linked to the “Citizen Company” program, including in the case of an employee who adopts a child.
National Early Childhood Network and the Legal Framework
The Legal Framework for Early Childhood implements at the federal level several points contained in the National Plan for Early Childhood, approved by Conanda, and which sets goals to be achieved by 2022, the year of the Bicentenary of Brazil's Independence. It is a letter of commitment from the country to guarantee compliance with the rights of children up to six years of age affirmed by the Federal Constitution, the Child and Adolescent Statute and the laws applied to education, health, social assistance and diversity.
